The role:
We are currently seeking an experienced Commercial Manager - Delivery to join our team based in either Thebarton, South Australia or Bibra Lake, Western Australia. As the successful applicant you will play a key role in leading the commercial workstream for construction delivery through the identification of contract-specific risks and opportunities. The role requires strategic thinking in designing commercial models that leverage financial drivers, optimise profit and deliver value for money to clients. A pragmatic and collaborative approach is required to deliver value to internal stakeholders, senior management and external clients and/or partners.
More specifically you will:
- Proactively assess commercial and contractual risks and opportunities, identify and implement appropriate controls and mitigants for project risks and escalate actual or potential issues to the National Commercial and Procurement Manager
- Develop the precedent contracts and commercial documents, tools and processes to deliver effective contract management and commercial engagement throughout the delivery phase.
- Lead the development, assessment, negotiation, approval and execution of high value high risk or complex agreements, variations or claims (such as extension of time).
- Act as the commercial point of contact to engage with and influence internal teams and external partners
- Provide sound advice on contractual interpretation and rights and obligations under the relevant head contracts or subcontracts in delivery (as required)
- Manage any issue or dispute resolution processes and insurance claims with oversight from the National Commercial and Procurement Manager
- Provide timely and strategic commercial advice to support decision making in delivery teams and the project governance function
- Must be willing and able to undertake contract administrative tasks to manage team workload
As our ideal candidate you will have:
- A bachelor’s degree in law, business, construction management or a related field or equivalent experience.
- 10 years of experience in commercial or contract management or in-house legal or a related role, preferably and in the construction or an engineering related industry.
- Strong understanding of contract law, relevant legislation and procurement rules and familiarity with complex contracts and commercial documentation
- Highly developed commercial acumen with experience with a variety of commercial frameworks/pricing models and understanding of risk allocation and financial matters
- Excellent written and verbal communication and influencing skills with the ability to build and maintain strong stakeholder relationships.
- Proven track record in negotiating and achieving favourable terms and within risk appetite
- Exceptional problem-solving and an analytical mindset to identify risks or inconsistencies in contracts
- Strong organisational and time management skills
- Attention to detail with high level of accuracy
- High level of integrity and confidentiality
